By renting equipment from Sucura Networks Inc. ("Sucura", "we", "us", or "our"), you ("Customer", "Renter", or "you") agree to be bound by these Rental Terms and Conditions. These terms govern all equipment rentals including generators, light towers, graders, and other equipment.
1. Rental Rates & Billing
1.1 Rental Periods
- Daily Rate: Based on a 24-hour period from time of pickup/delivery
- Weekly Rate: 7 consecutive days from pickup/delivery
- Monthly Rate: 30 consecutive days from pickup/delivery
- Grader Daily Rate: Includes up to 8 operating hours per day. Additional hours billed at $170/hour.
1.2 Usage Hours
Light Towers: Rental rates assume continuous operation (12-24 hours/day). Our pricing accounts for extended runtime, making it ideal for both lighting and power generation needs.
Motor Grader (John Deere 772G): Daily rate includes 8 operating hours. Hour meter will be checked at pickup and return. Additional hours beyond 8 per day will be billed at $170/hour.
1.3 Payment Terms
- Security deposit required at time of pickup or before delivery (see Section 2)
- Rental payment due upon return of equipment
- Pre-arranged fixed-term rentals (weekly/monthly) may require payment upfront
- Extended rentals may be invoiced weekly or bi-weekly by arrangement
- Accepted payment methods: Cash, e-transfer, cheque, credit card
2. Security Deposits
2.1 Deposit Amounts
- 30kW Generator: $500 deposit
- Light Tower: $400 deposit
- Boring Mole: $300 deposit
- John Deere 772G Grader: $5,000 deposit
2.2 Deposit Return
Security deposits will be returned within 5 business days after equipment is returned in good condition, less any deductions for:
- Damage repairs
- Missing or broken parts
- Excessive cleaning required
- Late return fees
- Additional fuel or operating costs
3. Fuel Policy
3.1 Fuel Requirements
- All diesel equipment is provided with a full tank
- Equipment must be returned with a full tank
- Customer is responsible for all fuel during rental period
- If returned without a full tank, a refueling fee of $150 + fuel cost will be charged
3.2 Fuel Type
IMPORTANT: All generators, light towers, and grader require diesel fuel only. Using incorrect fuel will result in damage charges and void any warranty protection.
4. Delivery, Setup & Pickup
4.1 Delivery Services
- Delivery available in Wawa and surrounding areas
- Delivery fees vary based on distance and equipment
- Standard delivery: $75-150 within Wawa limits
- Remote locations: Quote provided upon request
- Grader transportation requires prior arrangement
4.2 Customer Pickup
- Equipment can be picked up from our Wawa location by appointment
- Customer must provide suitable vehicle/trailer for transport
- We will provide basic operation instructions at pickup
4.3 Site Requirements
Customer is responsible for ensuring:
- Clear, level access for delivery and pickup
- Stable ground suitable for equipment placement
- Adequate space for safe operation
- Any necessary permits or site approvals
5. Operation & Maintenance
5.1 Operator Requirements
- Customer must be 18+ years old
- Motor Grader: Requires a competent, experienced operator. Operator services available for additional fee.
- Customer responsible for safe operation within manufacturer specifications
- Do not exceed equipment rated capacity
5.2 Customer Responsibilities
- Daily visual inspections (oil, coolant, damage)
- Operate equipment in safe, appropriate conditions
- Maintain adequate fuel levels
- Report any issues or damage immediately
- Secure equipment when not in use
5.3 Prohibited Uses
Equipment may NOT be:
- Used beyond rated capacity or specifications
- Operated by intoxicated or impaired persons
- Modified or altered in any way
- Sub-rented to third parties without written permission
- Used for illegal purposes
- Removed from agreed rental location without notice
6. Damage & Liability
6.1 Customer Liability
Customer is responsible for:
- All damage to rented equipment during rental period
- Normal wear and tear is expected and covered
- Damage from misuse, abuse, or negligence is customer's responsibility
- Lost, stolen, or vandalized equipment - full replacement cost
6.2 Insurance
Recommended: Customer should verify their business/liability insurance covers rented equipment. We can provide equipment valuation for insurance purposes upon request.
6.3 Third-Party Damage
Customer is liable for any property damage or personal injury caused by rented equipment during the rental period.
6.4 Damage Reporting
All damage must be reported immediately. Failure to report damage may result in additional charges.
7. Cancellations & Returns
7.1 Cancellation Policy
- 48+ hours notice: Full refund less $50 admin fee
- 24-48 hours notice: 50% refund
- Less than 24 hours: No refund (charged one day rental)
- Weather-related cancellations may be rescheduled without penalty
7.2 Early Returns
- No refunds for early returns on daily or weekly rentals
- Monthly rentals returned early: Prorated refund at weekly rate (minimum one week charged)
7.3 Late Returns
- Grace period: 2 hours after scheduled return time
- Late returns charged additional day at full daily rate
- Equipment needed by another customer: Late fees may be doubled
- Notify us if you need to extend rental period
8. Equipment Availability & Substitutions
- We make every effort to provide reserved equipment on scheduled dates
- Equipment may be unavailable due to maintenance, damage, or unforeseen circumstances
- We may offer comparable substitute equipment at same or lower rate
- If suitable substitute unavailable, full refund provided with no further liability
9. Limitation of Liability
IMPORTANT NOTICE:
- Equipment rented "as-is" after inspection by customer
- Sucura Networks Inc. not liable for project delays, lost profits, or consequential damages
- Our liability limited to rental fees paid
- Customer assumes all risk of equipment operation
- No warranties expressed or implied beyond basic equipment functionality
10. Governing Law
These terms are governed by the laws of Ontario, Canada. Any disputes will be resolved in Wawa, Ontario or nearest appropriate jurisdiction.
11. Changes to Terms
We reserve the right to update these terms at any time. Current terms apply to all new rentals. Major changes will be communicated to existing customers.
